Mr A, an expat living on the Gold Coast of Australia, contacted the asbestos solicitors at Seth Lovis & Co to advise him on an asbestos claim after he was diagnosed with malignant mesothelioma, an exceptionally aggressive type of asbestos related cancer. Mr Alan Gore, a senior litigation executive in the industrial disease team at Seth Lovis & Co was able to successfully pursue a claim for compensation against his former employers in the UK, North Thames Gas Works, even though he was living in Australia at the time of his claim.
Exposure to asbestos
Mr A was employed as a fitters mate by North Thames Gas Works in East London and worked there between 1958 and 1968. He was required to lag pipes, boilers, and central generators with liquid asbestos, which was used due to its heat-resistant properties. He was exposed to asbestos on a daily basis. He even remembers having ‘snow ball fights' with the dangerous material.
Mr A was exposed to airborne asbestos dust throughout his employment without being provided with any breathing protection, nor was he given any advice by his employers about the dangers of asbestos exposure.
Mr A moved to the Gold Coast in Australia in 1968 and when contacting the asbestos solicitors at Seth Lovis & Co was worried that this may negatively impact his potential case. However, Alan was able to prove his exposure to asbestos in the UK, at the North Thames Gas Works.
Due to the client's reduced life expectancy, Alan was able to win compensation of £150k, just months after the initial email enquiry with Seth Lovis & Co. Alan was also able to claim a state pension for Mr A in the form of Industrial Disease Disablement Benefit from UK government.
Alan Gore, a solicitor in Seth Lovis & Co Solicitors London team, states, "The fact that Mr A lived on the Gold Coast of Australia did not affect his claim as we were able to prove his exposure to asbestos in the UK. Sadly Mr A passed away a few months after we secured him a compensation award of £150k. Mr A was pleased that justice had been done and I know that he was glad he could secure his wife's financial future after his passing."
